1) Acceptance of Terms
These Terms of Service (“Terms”) govern your access to and use of Hero-Craft websites, the Forgeon waitlist, and our partnership/investor inquiry forms (collectively, the “Service”). By accessing or using the Service, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use the Service.
2) Eligibility
You must be at least 13 years old (or the age of digital consent in your jurisdiction) to use the Service. If you use the Service on behalf of an entity, you represent that you are authorized to bind that entity to these Terms.
3) Privacy & Cookies
Our processing of personal data is described in our Privacy Policy. Our use of cookies and similar technologies is explained in our Cookie Policy. By using the Service, you acknowledge those policies.
4) Our Services
Waitlist
You may join the waitlist to receive updates about Forgeon. Waitlist messages use a double-opt-in flow, and each email includes an unsubscribe option. Joining the waitlist does not guarantee access, availability, or any specific features.
Partnership / Investor inquiries
If you submit a partnership or investor inquiry, we will review it and may contact you. We are not obligated to enter into any agreement or continue discussions, and we may decline any inquiry at our discretion.
Beta, changes & availability
The Service (and any pre-release information, visuals, or demos) may change without notice. We may suspend or discontinue the Service, or any part of it, at any time. We do not guarantee error-free operation or uninterrupted availability.
5) User Content & Feedback
If you submit content (e.g., messages, links, files) via our forms, you represent that you have all necessary rights to do so and that the content is accurate and lawful. Do not share confidential or sensitive information in free-text fields.
If you send us feedback, ideas or suggestions, you grant Hero-Craft a worldwide, perpetual, irrevocable, sublicensable, royalty-free license to use and exploit that feedback for any purpose without obligation to you.
6) Acceptable Use
- No unlawful, infringing, deceptive, or harmful activity.
- No attempts to breach, scan, or test the vulnerability of the Service.
- No interference with the Service or other users (spam, scraping at scale, abuse).
- No impersonation or misrepresentation of your affiliation.
- Respect intellectual-property rights and applicable laws.
7) Intellectual Property
The Service, including visuals, logos, text, layouts, and underlying code, is owned or licensed by Hero-Craft and is protected by intellectual-property laws. Except as expressly permitted, you may not copy, modify, distribute, reverse-engineer, or create derivative works from the Service.
8) Third-Party Links & Services
The Service may include links to third-party websites or services (e.g., captcha, hosting, analytics). We are not responsible for third-party content or practices. Your use of third-party services is governed by their terms and policies.
9) Communications
By contacting us or joining the waitlist, you agree to receive the relevant communications. You can opt out of non-essential emails at any time via the unsubscribe link or by contacting hello@hero-craft.com.
10) Disclaimers
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WITHOUT LIMITATION WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. We do not guarantee that the Service will be error-free, secure, or uninterrupted.
11) Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, HERO-CRAFT WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF (OR INABILITY TO USE) THE SERVICE. In all cases, our total liability will not exceed one hundred (100) US dollars or the amount you paid to us (if any) in the twelve (12) months preceding the event giving rise to liability — whichever is greater. Some jurisdictions do not allow certain limitations; in such cases, the above limits apply to the fullest extent permitted by law.
12) Indemnification
You agree to indemnify and hold harmless Hero-Craft from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or in any way connected with your use of the Service, your violation of these Terms, or your violation of any rights of another.
13) Termination
We may suspend or terminate your access to the Service at any time, with or without notice, for any reason, including if we reasonably believe you have violated these Terms. Upon termination, the provisions that by their nature should survive will remain in effect (e.g., IP, disclaimers, limitations of liability, indemnification).
14) Governing Law & Disputes
These Terms and any non-contractual obligations arising out of or in connection with them are governed by the laws of Georgia (country), without regard to its conflict-of-laws rules.
You agree to the exclusive jurisdiction and venue of the courts located in Tbilisi, Georgia, and waive any objection to such courts on the grounds of improper venue or forum non conveniens.
Consumer carve-out (EEA/UK). If you are a consumer resident in the EEA or the United Kingdom, you also benefit from any mandatory consumer-protection provisionsof your country of residence and may bring claims in your local courts. Nothing in these Terms deprives you of rights you cannot contractually waive under the law of your country of residence.
For clarity, the United Nations Convention on Contracts for the International Sale of Goods (CISG) does not apply to these Terms.
Before filing any claim, the parties will try to resolve the dispute informally: the complaining party shall send a written notice to the other party with a brief description of the dispute and contact details. If the dispute is not resolved within 30 days of receipt, either party may proceed in court.
15) Changes to These Terms
We may update these Terms from time to time. The “Last updated” date will be revised accordingly. If changes materially affect your rights, we will provide additional notice where required. Your continued use of the Service after changes become effective constitutes acceptance of the updated Terms.
